1. Overview
This website is operated by Aloha Monde LLC, doing business as Montkai (“Montkai,” “we,” “us,” or “our”).
By accessing our website or purchasing from us, you agree to these Terms & Conditions (“Terms”). These Terms apply to all users of the site. Additional terms, including the Privacy Policy, Clairmont Custom Process, and Messaging Policy, and Warranty Policy, are incorporated herein by reference into these Terms.
If you do not agree to these Terms, you may not use our site or our services.
By using this site, you confirm you are at least 18 years old or the age of majority in your jurisdiction, whichever is greater.
2. Products & Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue styles, or modify offerings at any time and for any reason.
We strive to display materials, finishes, and colors accurately, but appearance may vary depending on screens and lighting. You agree and acknowledge that the final products may vary slightly from digital renderings on our site. Such slight variations are not defects.
All measurements and weights are approximate.
3. Orders & Cancellations
Orders are processed promptly to meet production and fulfillment timelines.
Orders are final once placed and cannot be modified or canceled.
If you have an urgent request, you may contact us and we will use commercially reasonable efforts to accommodate at our sole discretion, but changes are not guaranteed and may require additional fees and extend the delivery date.
4. Custom & Personalized Jewelry
Certain Montkai pieces are custom-made. By placing a custom order, you acknowledge:
● Proof approval is required before production
● Approved designs are produced as shown, subject to Section 2
● Customers are responsible for reviewing spelling and letter case
● Custom pieces are final sale once approved
● Once a custom order enters production, it cannot be canceled, modified or rescheduled
Quotations for any custom-made products are valid for 30 days. Monkai reserves the right to adjust pricing or cancel unpaid orders in the event of fluctuation in the market price of materials prior to the receipt of payment.
By submitting any handwriting, images, text, personal material or other content (the “Customer Content”), you represent and warrant that you are the owner of the Customer Content and the use of the Customer Content by Montkai does not infringe the rights of any third party.
Montkai reserves the right to decline or modify submissions not viable for production, durability, or wearability.
If Montkai agrees to handle customer-provided materials (e.g., heirlooms, loose stones), we accept such materials strictly at the customer’s risk. Montkai is not liable for damage attributable to inherent flaws, inclusions, or structural weaknesses in the material. In the event of damage, our liability is limited to the refund of the service fees paid.
5. Pricing & Payment
Prices are subject to change without notice.
We reserve the right to correct pricing errors and cancel orders placed at incorrect prices.
Applicable sales tax will be collected where required by law.
Payment must be received before production begins.
For custom pieces, production begins only after proof approval and the receipt of the full payment.
6. Production Timelines
Production timelines begin after proof approval (for custom pieces) or after order placement (for non-custom items).
All timelines are estimates, not guarantees. Delays may occur due to many reasons including but not limited to sourcing delays, workshop capacity restraint, or delays by shipping carriers.
7. Shipping & Delivery
Secure Shipping
Montkai uses insured shipping methods and may require adult signature upon delivery. If a product is returned to us due to your failure to accept delivery or an incorrect address, you will be responsible for any additional shipping and storage fees. If you fail to pay such additional fees or fail to accept the delivery within 90 days of the original delivery attempt, the product shall be considered abandoned and we reserve the right to liquidate the item, recycle the material or dispose of the item at our sole discretion. You waive any right to a refund, credit or replacement of the abandoned property.
We do not ship to P.O. Boxes.
Customers are responsible for providing accurate shipping information and ensuring someone is available to receive the package.
Risk of loss transfers upon confirmed delivery to the provided address.
Montkai is not responsible for packages lost or stolen after confirmed delivery.
8. Returns & Exchanges
Standard (non-custom) items may be eligible for return per our return policy.
Custom, personalized, and made-to-order items are final sale.
Return Verification
All returns are subject to inspection.
Items must be returned:
● unworn
● unaltered
● in original condition and packaging
Montkai reserves the right to refuse returns that:
● show signs of wear or damage
● have been altered or resized
● do not match original specifications
● are missing components or packaging
Items failing inspection may be returned to sender without refund.
9. Fraud Prevention & Chargebacks
Montkai reserves the right to refuse service, cancel orders, or deny returns if fraud or abuse is suspected.
For high-value orders, we may request additional verification.
Customers agree to contact Montkai to resolve any issue before initiating a chargeback.
10. Jewelry Care & Wear & Repairs
Fine jewelry should be worn with care.
Delicate areas may bend or wear over time depending on use. Normal wear and tear (including but not limited to scratches, fading, tarnishing, bent prongs and discolorations due to exposure to lotion, perfumes or chemicals) is not considered a defect.
Proper care helps preserve your jewelry.
Repair services may be offered at our discretion and may incur a fee.
Montkai does not provide a lifetime warranty unless explicitly stated.
11. Intellectual Property & Feedback
All content on this site — including designs, logos, text, and imagery — is the property of Montkai and may not be used without permission.
Customers retain ownership of the Customer Content but grant Montkai and its affiliates and contractors a worldwide, non-exclusive, irrevocable, royalty free and fully paid-up right to use the Customer Content in connection with customers’ orders.
You acknowledge and agree that any questions, comments, suggestions, ideas, or feedback ("Feedback") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Feedback for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Feedback, and you hereby warrant that any such Feedback are original or that you have the right to submit such Feedback. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Feedback.
12. Limitation of Liability & Indemnification
To the fullest extent permitted by law, Montkai’s aggregate liability with respect to any product or any service is limited to the purchase price of such product or service actually received by us. To the fullest extent permitted by law, except as set forth in the Terms, Montkai does not make any other warranties or representations of any kind, whether express, implied, statutory or otherwise, with respect to any product or service, including, without limitation, warranties of merchantability, fitness for a particular purpose or non-infringement.
Montkai is not liable for indirect, incidental, special, or consequential damages.
You shall indemnify, defend and hold Montkai harmless against any costs, losses, expenses, liabilities or damages in connection with any claim or proceeding arising from (i) Monktai’s use of any Customer Content or other material provided by you, (ii) any breach of this Terms & Conditions by you and (iii) your violation of applicable laws.
13. Right to Refuse Service
We reserve the right to refuse service or cancel orders at our discretion.
14. Force Majeure
Montkai shall not be liable for any delay or failure to perform any of its obligations under these Terms if such delay or failure is caused by an act of God, war, terrorism, civil commotion, labor disputes, fire, flood, disaster, public health emergency, government order, material or supply shortages, shipping carrier failure, or any other event beyond Montkai's reasonable control. In the event of such a delay, Montkai’s time for performance shall be extended for a period equal to the duration of the delay.
15. Governing Law
These Terms are governed by the laws of the State of New Jersey (without regard to the conflicts of laws provisions thereof or the UN Convention on the International Sale of Goods). You agree that any claims relating to these Terms or our products and services will be brought in the courts located in [Hudson County, New Jersey] and You agree to waive the right to a jury trial.
16. Changes to Terms
We reserve the right to update these Terms at any time. Changes take effect upon posting on our website and your continued access to our website or purchase of any products constitutes acceptance of the changes.
